KPhotoApp License Agreement and Terms of Use

§ 1 Definitions

Software: KPhotoApp.

Copyright: The copyright of this software belongs to TCM I KULTURA PROSTA SPÓŁKA AKCYJNA and is protected by Polish copyright law, EU copyright law, international copyright conventions, and other laws and regulations related to intellectual property.

License: This agreement grants the user a non-transferable, non-exclusive, revocable, and non-sublicensable limited license. The licensee obtains only the right to use this software within the scope specified in this agreement.

Licensor: TCM I KULTURA PROSTA SPÓŁKA AKCYJNA, located at ul. Dajwór 14/19, 31-052 Kraków, registered in the register of entrepreneurs maintained by Sąd Rejonowy dla Krakowa Śródmieścia w Krakowie, XI Wydział Gospodarczy Krajowego Rejestru Sądowego under number 0001055970, NIP: 6762650432, REGON: 526269887.

Licensee: The user.

§ 2 Payment and After-sales Service

The current charging model of the software is a one-time payment, and the licensee can obtain the software's future versions for free when they become available. If the software's charging model changes in the future, the licensee will not be affected.

The licensor does not commit to continuously releasing updates, and the licensor may teminate the development of the software at any time.

For solving any problem related to the software, the licensee can contact the licensor by sending an email to biuro@tcmkultura.pl. Generally, the licensee can get a response within 48 hours in business days.

§ 3 GDPR and Privacy Policy

The working mechanism of the software is to open and convert supported image and PDF formats. The software will only scan supported image and PDF files in the system's default picture folders or folders set by the user to build cache data.

The software will not identify, collect, or send the user's personal data.

For the personal information provided by the user during payment, please refer to "Policy for Processing Personal Data".

§ 4 Disclaimer

Under no circumstances shall the licensor be liable for any damages or losses caused to the licensee due to the use of this software. The licensor does not assume any obligations, warranties, or guarantees regarding how the licensee uses the software.

§ 5 Third-party Libraries

The software uses Qt and third-party libraries in a dynamically linked manner. Users can view the license agreements of Qt and third-party libraries in the software's "Settings" interface and should also comply with these license agreements.

§ 6 Dispute Resolution

If the licensee does not comply with the terms of this agreement, the licensor has the right to revoke the license and terminate this agreement.

This agreement is governed by the laws of the Republic of Poland. Any disputes will be resolved by the competent court at the licensor's registered office. Matters not provided for in this agreement shall be governed by the provisions of civil law, intellectual property, and other relevant laws and regulations.
